1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the website at dailybrainhub.com and all associated pages, games, blog posts, and content (collectively, the "Site"), operated by DailyBrain ("we", "us", "our").

By visiting, browsing, or using the Site in any way, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. These two documents together constitute the entire agreement between you and DailyBrain regarding your use of the Site.

2. Eligibility

The Site is available to users of all ages. However, by using the Site you represent that:

• If you are under 13 years of age, you have obtained verifiable parental or guardian consent before using the Site.
• If you are between 13 and 18 years of age, you have reviewed these Terms with a parent or guardian who agrees on your behalf.
• Your use of the Site does not violate any applicable law or regulation in your jurisdiction.

3. The Service

DailyBrain provides free browser-based puzzle games including Word Ladder, Daily Detective, Color Matcher, Finger Cricket, and Daily Emoji Puzzle (some of which are still in development), along with associated blog content and educational articles (the "Service").

The Service is provided free of charge. We reserve the right to introduce optional paid features in the future. Free access to existing games will not be removed to force payment unless explicitly stated with reasonable advance notice.

Game progress and daily streaks are stored in your browser's localStorage. They are not backed up on our servers. We are not responsible for data lost due to browser clearing, device changes, or software updates.

4. Games — No Liability

4.1 Game Accuracy

While we make every reasonable effort to ensure the accuracy of puzzle content — including word definitions, detective case answers, and emoji puzzle solutions — we cannot guarantee that all content is error-free at all times. If you believe a puzzle contains an error, please contact us and we will investigate.

4.2 Scores and Streaks

Daily puzzle streaks and scores are stored locally in your browser. We are not responsible for loss of streaks or scores resulting from browser data being cleared, device failure, switching devices, using private/incognito browsing modes, or any other cause. We cannot restore lost streaks or scores under any circumstances.

4.3 Game Availability

Puzzles are designed to refresh daily at midnight. We do not guarantee that new puzzles will be available at any specific time. Technical issues, content updates, or maintenance may occasionally delay puzzle refreshes. We are not liable for missed puzzles or streak breaks caused by our servers being unavailable.

4.4 No Professional Advice

Nothing on DailyBrain constitutes professional advice of any kind, including but not limited to medical, psychological, educational, or therapeutic advice. The games are entertainment products only.

4.5 Use at Your Own Risk

You use all games on DailyBrain entirely at your own risk. We are not responsible for any harm, loss, or damage of any kind — direct or indirect — arising from your use of or inability to use any game on the Site.

5. Intellectual Property

All content on the Site — including but not limited to puzzle designs, detective case text, game logic, source code, CSS, graphics, logo, blog articles, and the DailyBrain name — is owned by DailyBrain or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes only.

You may not:

• Copy, scrape, reproduce, or redistribute any puzzle content, game logic, or blog text without our written permission
• Use automated tools, bots, or scrapers to access the Site or extract puzzle content
• Reverse-engineer, decompile, or attempt to extract the source code of any game
• Remove or alter any copyright, trademark, or other proprietary notices
• Use the DailyBrain name or logo without prior written consent

The concept of the Word Ladder game is in the public domain (originally invented by Lewis Carroll in 1877). However, our specific implementation, puzzle content, and presentation are our original work and are protected.

6. Acceptable Use

By using the Site, you agree not to:

• Use the Site for any unlawful purpose or in any way that violates applicable laws or regulations
• Attempt to gain unauthorised access to any part of the Site or its infrastructure
• Transmit any viruses, malware, or other harmful code
• Interfere with or disrupt the Site's servers, networks, or systems
• Use the Site to harvest or collect personal data about other users
• Impersonate DailyBrain or its staff in any communication
• Use automated scripts to interact with games in a way that simulates human gameplay for the purpose of data extraction or manipulation of puzzle content

7. Third-Party Services and Advertising

The Site displays advertisements served by Google AdSense and potentially other advertising networks. These are third-party services over which we have limited control. By using the Site you acknowledge that:

• Third-party ad networks may use cookies and tracking technologies as described in our Privacy Policy
• We are not responsible for the content, accuracy, or practices of third-party advertisements
• Clicking on an advertisement takes you to a third-party site governed by that site's own terms and privacy policy
• We do not endorse any products or services advertised on the Site unless explicitly stated

We are not liable for any loss or damage you suffer as a result of clicking on or relying on third-party advertisements.

8. Affiliate Links

Some links on DailyBrain — particularly in blog posts and articles — may be affiliate links. If you click an affiliate link and make a qualifying purchase, we may receive a commission. Affiliate links will be clearly marked or disclosed at the point of use.

Affiliate commissions do not affect the price you pay. We are not responsible for the products, services, or websites to which affiliate links point. Your transaction is solely between you and the third-party merchant.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL GAMES, CONTENT, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DAILYBRAIN AND ITS OPERATORS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Loss of game progress, streaks, or scores
• Business interruption
• Personal injury or property damage arising from your use of the Site
• Any errors or inaccuracies in puzzle content
• Any conduct or content of third parties on the Site
• Any damage caused by third-party advertisements

Our total aggregate liability to you for any and all claims arising from your use of the Site shall not exceed the amount you have paid to us in the twelve months preceding the claim (which will be zero for free users).

Some jurisdictions do not allow the exclusion or limitation of certain types of liability. In such jurisdictions, the limitations above apply only to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless DailyBrain and its operators, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of or inability to use the Site
• Your violation of these Terms
• Your violation of any third-party right, including intellectual property or privacy rights
• Any content you submit to us via contact forms or other means

12. Availability and Modifications

We do not guarantee that the Site will be available at any particular time. We reserve the right to:

• Modify, suspend, or discontinue any part of the Site at any time without notice
• Change the content, format, or rules of any game
• Introduce new games or retire existing ones
• Perform maintenance that may temporarily interrupt access

We will endeavour to provide advance notice of significant changes but are not obligated to do so.

13. Termination

We reserve the right to terminate or restrict your access to the Site at our discretion, without notice, if we reasonably believe you have violated these Terms or engaged in conduct harmful to the Site, other users, or third parties. Because no accounts are required, termination may take the form of blocking your IP address or other technical measures.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with applicable law. Any dispute arising from these Terms or your use of the Site shall first be addressed by contacting us directly to seek an informal resolution.

If an informal resolution is not reached, disputes shall be resolved through binding arbitration or in the courts of the jurisdiction in which DailyBrain operates, to the extent permitted by law. You waive any right to a class-action lawsuit or class-wide arbitration in connection with any dispute arising from these Terms.

15. Changes to These Terms

We may update these Terms at any time. The updated version will be posted on this page with a revised effective date. Because we do not collect email addresses from general visitors, we cannot notify you directly. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
